BY ACCEPTING THE TERMS OF THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE LEGALLY BOUND BY ALL OF THE TERMS, CONDITIONS AND NOTICES CONTAINED IN THIS AGREEMENT JUST AS IF YOU HAD SIGNED THIS AGREEMENT. The Services are described at http://www.YourHomesToday.com.
The Subscription Terms and Conditions (the "Subscription Terms") are a contract between you and YourHomesToday, LLC (YourHomesToday.com), and apply to your use of and subscription to ("Subscription") and/or advertising solutions (“Advertisements”) for one or more of YourHomesToday.com’s paid products or services (collectively the " Services").
The Your Homes Today Service offers a variety of advertising and research solutions for home related service providers servicing the Santa Clara County area. By registering as a user, service provider, or advertiser with Your Homes Today you agree to provide full and complete information.
Membership Policy
The normal membership fee for Your Homes Today is billed at a monthly rate of $2.99 to potential Users. The normal membership fee for Service Providers is $29.99 per month. However, membership fees for both Users and Service Providers are currently waived for 2015 until further notice and this offer is subject to change without any notice. Take note that all subscription fees are automatically renewed. By using the service you acknowledge that Your Homes Today reserves the right to modify membership terms and conditions at any time. Debit and credit cards are approved forms of payment for monthly and annual membership and advertising fees and will be deducted from your account based upon your subscription term length.

Cancellation Policy
You will have the right to cancel the Services at any point by calling customer service at 408-531-9340 and a YourHomesToday.com Customer Support Member will be happy to assist you. If you choose to do so, you recognize that it may take up to 72 hours for your advertising campaigns to be removed. Additionally, no amount that you may have prepaid for the Services will be refunded and cancellation will be effective at the end of the then current Subscription period. If you violate any of these Subscription Terms, YourHomesToday.com may, in addition to any other rights and remedies it may have, immediately terminate your Subscription to the Services without any notice or other action by YourHomesToday.com. In the event of such termination, no amounts that you may have prepaid for use of the Services will be refunded. If YourHomesToday.com discontinues the Services or cancels your Subscription other than for a breach or violation of these Subscription Terms, YourHomesToday.com will either, at its sole option, continue to provide the Services for the remainder of your Subscription Term (up to a maximum of thirty (30) days) or refund you a prorated portion of the Subscription Fees for the current Subscription Term.
Account Security
At the time of initial sign up you will be asked to set up your own username and password. This information is to be used solely by you and you are fully responsible for all activities that occur under your user identified login information. In addition, you agree not to utilize the account, username or password of another YourHomesToday.com user at any time. Should you suspect unauthorized activity of your account then you need to immediately contact Your Homes Today and report the unauthorized account activity as you are solely responsible for any and all use of your account.
Age Requirements
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are 18 years of age or older and that you agree to abide by all of the terms and conditions of these Subscription Terms.
Featured Service Providers
Your Homes Today is not responsible, nor liable for any content, advertisements, product sales or services available (or unavailable) through providers listed on the website. Furthermore no loss or damage whether caused or alleged to be caused with use of service provider may be blamed on YourHomesToday. You are responsible for your own research and deeming whether a service provider is trustworthy and professional.
Responsibility of Abiding by Terms and Conditions
You are responsible for abiding by the terms and conditions set forth in this agreement as well as any local California (and other state laws), county laws and national laws that apply.
Should you fail to abide by the terms and conditions set forth by Your Homes Today then YourHomesToday has the right to restrict, suspend or terminate your access to the website.
Modification of Terms
Your Homes Today has the right to modify the terms and conditions at any time according to this agreement. Any new modifications will be made effective immediately and posted as an update on the website (www.yourhomestoday.com). It is your responsibility to review these revised terms and conditions on a regular basis and discontinue utilizing the service if you do not accept the modifications made to the agreement.
Availability
The internet can sometimes be unreliable, as a result Your Homes Today is not responsible for any damage, delays or other issues resulting from such problems.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.
Cookies
As with most internet sites, Your Homes Today utilizes cookies in order to retrieve details for visits to the website.

Arbitration

Any such controversy or claim must be arbitrated on an individual basis, and must not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration must be conducted in San Jose, California, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either YourHomesToday.com or you may seek any interim or preliminary relief from a court of competent jurisdiction in San Jose, California, as necessary to protect the rights or property of you or YourHomesToday.com.
